The term UWSC will be interpreted as the "Executive Committee of the University of Warwick Skydiving Club" for these terms and conditions. UWSC reserve the right to change/modify/amend these terms and conditions without notice. 'You' is defined as the person agreeing to these terms & conditions.

2. Web Site Content
This Web site is owned and operated by UWSC. Except where otherwise indicated, the content featured or displayed on this Web site, including, but not limited to, text, graphics, photographs, images, moving images, sound, illustrations and software, belong to UWSC, its licensors and its content providers, and is protected by copyright, trade dress, trademark and other laws relating to intellectual property rights, of both the United Kingdom and foreign jurisdictions. Unauthorized use of the materials available on this Web site is strictly forbidden.

Whilst every effort has been made to ensure the accuracy of information displayed on this site no warranty or representation is given as to its quality, accuracy or completeness. It is the responsibility of the user to judge the accuracy of information before relying on it in any way. UWSC will accept no responsibility for any loss or damage of whatever nature arising out of the use of, or inability to use, this site, or from any error or omission in information contained in the site. UWSC reserves the right to amend or otherwise alter the information displayed on this site.

There are links on this site that will let you leave the UWSC site and go to sites that are not under the control of UWSC. UWSC is not responsible for the contents of any linked site or any changes or updates to such sites. UWSC is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by UWSC of the site.

3. Acceptable Use
3.1. Personal Identification
All functions (course signup & forum use) on this site will require your username and password, chosen at time of registration. Do not represent yourself as another person.

3.2. Photo Facility
The digital media storage feature in this website is there for the exchanging of club related images only. Any attempts to upload pornographic or other such unsuitable media will result in expulsion from the club.

3.3. Use of Language
No communication between club members should not be malicious or designed to offend. In particular, the use of swear words or undue profanity is discouraged. By participating in any discussion, you undertake to indemnify us and our clients against any liability arising from any obscene, defamatory, seditious, blasphemous or other actionable statement published by you on this site and against all damages, losses, claims and costs (including without limitation fines and expenses arising out of or incurred in conducting or defending any proceedings) arising from any such actionable statements.

3.4. Conduct of Discussion
The Discussion Forum is intended primarily for topics relating to UWSC and for the discussion of items of membership interest. Please try to keep to the topic. Your message should be within the scope of the subject under discussion. If you make a contribution that is inappropriate to the subject under discussion, you may be directed by the Moderator not to raise the matter further. No reference should be made to the personality of other participants in a discussion nor should attacks be made on an individual's character unless the person concerned has already chosen to bring his or her personality into the issue under discussion. One to one arguments, disagreements and disputes of a personal nature must be conducted through private Email and not through public discussion. You should remember that you are legally responsible for what you write. By participating in a discussion, you undertake to indemnify us and our clients against any liability arising from any breach of confidentiality, copyright or other intellectual property right published by you on this site and against all damages, losses, claims and costs (including without limitation all expenses incurred in conducting or defending any proceedings) arising from any such publication. You must not make statements that are libellous, obscene, seek to incite racial hatred or otherwise break the laws of the United Kingdom.

3.5. Private Email and Club / Society emails
If a person has sent you a private Email you may not forward it to a public discussion group without the prior consent of the person who sent it. This does not prevent you forwarding private e-mail to a Moderator should you consider this appropriate. Any contact information you may be granted access to on the site should remain within it and not used for any other external emailing purposes. Any unauthorised attempt to extract or expose personal information for use outside of UWSC will be subject to disciplinary procedures.

3.6. Complaints about a Breach of these Rules
Complaints about a breach of these Rules should ONLY be made by private e-mail to the club president in the first instance.

3.7. Deliberate Abuse and / or Misuse of the UWSC site
Any attempt to circumvent or manipulate your access rights to the site will be treated as a disciplinary offence and treated in accordance with the UWSU disciplinary procedures. Your access to this site is granted to you as an individual and your login details should be treated as strictly private and confidential. It is a disciplinary offence to share your access details with other users. Should you suspect that your account is being used by another person, you should change your password immediately and contact help@skydivewarwick.co.uk.

4. Deposits
Any deposits paid for services provided by the club are non-refundable under all circumstances, unless a valid doctors certificate of illness can be provided. Sometimes at the sole discretion of UWSC deposits may be refunded if for whatever reason outside of UWSC's control services had to be cancelled or resheduled. Normally in order to secure your place a full deposit must be recieved. UWSC reserves the right to give your place to another individual if they pay the deposit before you.

5. Payments
Payments accepted by UWSC for services include cash, cheque or online payment. UWSC will endevour to make sure payments are received and processed quickly but do not accept any responsibility for damages, losses, claims and costs due to a delay.

6. Charity Skydiving
By signing up to a charity skydive, you agree to raise the minimum funds stated in advance of your jump. You may lose your deposit if you pull out from the jump. Individual cases will be decided by UWSC. In the event of not raising enough money, and not paying the balance yourself, you will not be permitted to jump.

7. Photos
The Skydiving Club retains the right to use any photos or other digital media you acquire on any UWSC trip/social for advertising and recruitment purposes. You do however, retain the copyright for media for any other purpose.

8. Personal Fitness
When signing upto any services offered by UWSC you confirm that you are physically fit to take part in the sometimes demanding conditions involved in the sport of skydiving. If you are unsure as to your physical condition please see your GP.

9. Privacy Policy
When you access or login to this Web site, some information such as the site that referred you to the UWSC Web site, your IP address, and your email address may be automatically collected as part of the operation of this Web site, an automatic session cookie may also be added to your computer for the purposes of further site functionality. We may use this information to generate user profiles and to personalize our Web site to your particular interests. UWSC does not share information with other companies, and does not sell its user information. Any personal information we collect may be used for such purposes as processing transactions, customer service, marketing, product and development, recruiting and facilitating subsequent use of this Web site. Unless you opt out of receiving promotional materials, we may from time to time notify you of special promotions, new products or services, or other information that may interest you. We explicitly reserve the right to disclose any such personal informat ion if required to do so by law, or in the good faith belief that such action is reasonably necessary to comply with legal process, respond to claims, or protect the rights, property or safety of our company, employees, customers, or the public.

These terms shall be governed by English law and are subject to the exclusive jurisdiction of the English Courts. Nothing in these terms shall exclude liability for fraudulent misrepresentation.
